This document defines the terms and conditions for the engagement of Coombes Design and Drafting. Unless otherwise agreed to in writing by both parties, these terms and conditions commence one the signed and dated engagement form has been returned to Coombes Design and Drafting.
Cost and Fees
Costs will be quoted and agreed upon before the commencement of work. The sketch fee will include the initial office or site meeting, drafting and design work and all communication (i.e emails/phone calls) in relation to the initial design. Substantial changes (greater than 70%) of the initial design) may incur additional sketch fees. Additional brand new designs on top of the initial design will incur an additional sketch fee. All additional costs will be documented in writing and to be signed prior to commencement. Working Drawing fees include the finalized following plans:Site plan, Floor plan, Elevations and Sections, Flooring system Plan, Set out Plan, Bracing Plan and Tie-Down Plan. Please note that all steel and concrete work must be designed by a registered engineer. All timber framing detail over 3M ceiling heights and above N4 Wind rating are to be designed by a registered engineer.Energy Efficiency report to be produced by a licenced assessor (outside source).
Payment
The Client agrees to pay Coombes Design and Drafting in accordance with the signed quote/engagement notice.The client will be required to make payment on completion of work prior to the hand over of any documentation or drawings. All payments must be paid with in 30 days. In the event of cancellation, clients may need to pay remuneration for work provided up to the cancellation date. All cancellations must be made in writing and can be emailed to coombesdrafting@gmail.com
Project Copyright
Coombes Design and Drafting reserves all rights over working files and new design work. The CLIENT does not have the right to resell, reuse or re-purpose any design or content supplied as part of this agreement unless specified in writing.
The CLIENT indemnifies Coombes Design and Drafting against any loss or damage arising directly or indirectly from any designs supplied to Coombes Design and Drafting by the client.
Force Majeure
Coombes Design and Drafting shall not be deemed in breach of this Agreement if Coombes Design and Drafting is unable to complete the Services or any portion thereof by reason of fire, earthquake, labor dispute, act of God, death, illness or incapacity of Coombes Design and Drafting or any local, state, federal, national or international law, governmental order or regulation or any other event beyond Coombes Design and Drafting control (collectively, “Force Majeure Event”). Upon occurrence of any Force Majeure Event, Coombes Design and Drafting shall give notice to the CLIENT of its inability to perform or delay in completing the Services and shall propose revisions to the schedule for completion of the Services.
Errors and Omissions
It is Coombes Design and Drafting responsibility to check carefully for accuracy in all respects, ranging from spelling to technical illustrations. However Coombes Design and Drafting is not liable for errors or omissions. The CLIENT indemnifies Coombes Design and Drafting against any loss or damage arising directly or indirectly from any errors and omissions.
